TERMS AND CONDITIONS OF PARTICIPATION
These Terms and Conditions govern participation in outdoor recreational activities organized by the company Be Far Out, in accordance with applicable Greek law. The latest version of the Terms and Conditions of Participation is available at www.befarout.gr or in printed form to be completed in Greek and English.
By submitting the participation form and/or paying the deposit, the participant declares that they have read, understood, and unreservedly accept these terms and conditions.
General
Be Far Out provides guidance and support services for outdoor recreational activities, such as hiking, mountaineering, river trekking, via cordata, rappelling, and related activities.
The values of Be Far Out, which were a necessary condition for the Terms and Conditions of Participation, are the protection of the human integrity of the participants and the integrity of the environment in the activities of Be Far Out. An essential factor is the unhindered cooperation between all participants, coexistence with nature, and the completion of the activity with nothing less than positive experiences.
Reservations – Advance Payments – Cancellations
The applicant must inquire about the availability of places in each activity they wish to participate in via the contact links provided. Participation in an activity requires timely reservation. The reservation is completed upon payment of an advance payment or the full amount, as specified by Be Far Out each time. Failure to pay the full amount on time may result in cancellation of the reservation.
The advance payment is 70% of the total amount for each activity, and the balance is paid before the start of the activity. Please note that the starting point of the activity may not have network coverage, so the remaining amount may not be paid via a digital platform.
In case of cancellation due to the participant’s fault, the amount is refunded in full up to 48 hours before the start of the activity, with written notice. Otherwise, the entire amount paid will be retained or a change of date will be scheduled for the next available excursion after contacting Be Far Out.
The visitor is required to show proof of payment for the reservation if requested to do so by a Be Far Out representative.
Any bank charges or third-party charges burdens the visitor.
Nature of Activities – Assumption of Risk
Outdoor activities involve increased and inherent risk due to the nature of the environment, weather conditions, and physical exertion. The participant acknowledges and accepts that they are participating at their own risk and fully assumes the relevant risk. They must be aware of the nature of the activities to which they will be exposed, as described in the relevant announcement for each excursion or trip, and if they have any doubts, they may contact Be Far Out with any questions.
Participation Requirements
Participants must be in good physical and mental health, be physically fit, and disclose any medical issues that may affect their participation. Be Far Out reserves the right to exclude anyone who does not meet the safety requirements. In addition, participants must bring and use the appropriate clothing required for the activity.
Participation of Minors
Minors may participate only with the written consent of a parent or legal guardian and provided that the specific safety conditions (age limits, etc.) for each activity are met. Participants are fully responsible for the actions of the minors they accompany and must always supervise them throughout the program. Parental Responsibility Statement is provided in printed form by Be Far Out and must be completed before the start of the activity. Be Far Out provides a special climbing harness for young children where required.
Group Participation
Special terms may apply to group participation, which will be communicated prior to booking. The group leader is responsible for informing and obtaining the agreement of the members regarding these terms and conditions. The group leader is defined as the person who has paid the reservation fee on behalf of the participants.
Participation with pets
Be Far Out creates pet-friendly activities wherever possible.
Participation with dogs in hiking activities is permitted if they are tied to their guardians in positions indicated by the guide or that the pet does not prevent the completion of the activity due to unfavorable access to the target area. In the event that the dog is disturbed by other participants, resulting in an attack, Be Far Out and its guides bear no responsibility for the incident. Participants must keep their dogs leashed throughout the activity. Exceptions may be made with the necessary approval of the guide after consultation. If the guardian does not comply with the guide’s instructions, the guide reserves the right to refuse participation in the activity.
Accessibility to the activity area
Participants are responsible for arriving at the starting point of the activity on time, as well as for departing from the end point of the activity. Be Far Out is obliged to announce the starting and ending points of the activity in the excursion announcement. Further instructions to visitors may be given upon their request to Be Far Out.
Participants' Obligations
Participants must:
- Not to damage the environment in which they are accompanied during the activity.
- Respect the environment in which the activity takes place.
- Not to leave behind any objects or rubbish they have created and to ensure that they collect them during the activity.
- Follow the instructions of the Be Far Out guides.
- Use the appropriate clothing announced for the activity, as well as the equipment provided by the guide during the activity.
- Return the equipment provided by the guide during the activity in good condition. Any damage caused by the visitor will be charged to them for replacement, in consultation with Be Far Out.
Limitation of Liability
Be Far Out makes every effort to ensure the safe conduct of activities by selecting suitable routes, providing instructions, and providing experienced guides. However, each participant remains personally responsible and accepts the reasonable risks that may arise during their participation in the activities. Be Far Out is not responsible for injuries, losses, or damages due to unforeseeable factors, force majeure, participant negligence, or failure to comply with instructions. Its liability is in line with the limits set by Greek laws. Be Far Out and its guides are not entitled to request detailed or sensitive medical information. The decision to provide information is solely up to the participants.
Be Far Out is not responsible for:
- Injuries due to personal negligence, straying from the trail, or uncontrolled or unpredictable behavior.
- Consequences of false or concealed health statements (especially in cases of allergies to insects or other allergens).
- Damage to personal belongings during the activity.
- Unpredictable natural changes in the terrain.
Be Far Out bears no responsibility whatsoever and participants cannot claim compensation for failure to provide the service due to the following reasons:
- Failure to comply with the guide’s instructions.
- Delayed arrival at the designated meeting point.
- Inappropriate behavior.
Programme changes by Be Far Out or Mountain Guides
Be Far Out reserves the right to modify or cancel a programme for safety reasons (weather conditions, other serious reasons) without further obligation to compensate. In the event of an accident or emergency (e.g., injury, illness, physical obstacles), the activity may be modified or interrupted, depending on the severity of the incident and at the discretion of the guide, without further obligation to compensate.
Program Changes by Participants
Requests for changes by participants are considered on a case-by-case basis and are only accepted if they are feasible and do not compromise the safety or organization of the activity.
Weather Conditions & Schedule Changes
Excursions are directly dependent on weather conditions. In case of adverse conditions, Be Far Out may modify, postpone, or cancel the activity.
In case the weather conditions are not prohibitive for the cancellation of the excursion or part of it (e.g., simple cloudiness or light drizzle) Be Far Out will not take the initiative to cancel the excursion and will not be liable for any compensation. In the event of postponement of the excursion, the date will be changed to the next available date after contacting Be Far Out.
In the event of adverse weather conditions, Be Far Out will notify guests more than 48 hours in advance so that they can choose to cancel their reservation in a timely manner or change the date of the activity to the next available date after contacting Be Far Out.
Equipment & Safety
Be Far Out provides only certified equipment for the safety systems of participants, which bears the appropriate certifications and uses only official methods of securing participants.
Participants are required to have or use the equipment specified by Be Far Out. Non-compliance may cause exclusion from the activity.
Accident Insurance
Be Far Out has basic civil liability insurance…………., which does not replace the participant’s personal insurance. It is recommended that participants have personal insurance coverage.
Notification of Complaints – Dispute Resolution
Any complaints should be submitted in writing within a reasonable period to the contact details provided. Every effort will be made to resolve any dispute amicably; otherwise, the courts of Be Far Out’s registered office shall have jurisdiction.
Photos & Videos – General Data Protection Regulation
During the activities, photos or videos may be taken for promotional purposes. Participants consent to their use, unless they state otherwise in writing. Personal data is processed in accordance with Law 4624/2019.
Applicable Law
These terms are governed by Greek law. The courts of Greece shall have jurisdiction over any dispute.
